I. Rights and Responsibilities

An order at Mart4Art.bg can be made by anyone who accepts these Terms of Service, as persons under the age of 18 must have the consent of a parent or guardian.
Copying and unauthorized use of any part of the content of the website is forbidden. The published hyperlinks to other web sites are provided for your convenience and we are not responsible for their content.

We do not guarantee the availability of individual products and we may terminate the sale of any of them at any time and without notice. Some of the products we offer have special requirements for use, they have to be applied with caution and should not be used by children. Our responsibility is limited to the value of the product on its own until it is dispatched, and we do not commit to consequences arising from misuse and unawareness on your side. Also, we are not responsible for defects in the content of the packaged product caused by the manufacturer, as well as for non-conformance of the colors of the actual products and the images on the website due to the specificity of the monitors on the different devices. We cannot guarantee that the name, shape, size, and overall design of the product package you receive will be the same as the picture on our site as it is possible for the manufacturer to be at the time of updating the packages for the respective series of products.

II. Security

Creator and owner of the trademark Mart4Art is Nick Barzev EOOD, a company registered under the Commercial Law of the Republic of Bulgaria, with Unique Reference Number (URN): 201911809 and VAT Number: BG201911809. As a legal entity, Nick Barzev EOOD is also registered in the Commission for Personal Data Protection under the number 384990, which entitles us to be an administrator of personal data. Additionally the information that you have provided is stored on the server on our website and is secured by an SSL certificate. Your personal data are treated as strictly confidential information which is protected by the Personal Data Protection Act (PDPA) in Bulgaria and it is used to administer the website, to execute your order and to improve the services we offer. We do not provide any information to third parties except in the cases described below, and they are obliged to apply them in accordance with the instructions of Mart4Art and in compliance with the laws on the use of personal data. Part of your data - name, address, and telephone are provided to the shipping company. Your username and email address are used by Yotpo, in order to post a product review and evaluation. In case that your data is requested by the regulatory authorities, following an investigation or alleged illegal activity, we are obliged to provide the information we ask for.

III. Order

For the correct execution of your order, please make sure that the information you enter is correct and up-to-date. The communication between you and us will be via e-mail, and the technical steps required to create an electronic contract are as follows:

Step 1. You make the order of your desired products and at the end of the process press the "I confirm my order" button. 

Step 2. We will send you an email to confirm the ordered products.

Step 3. Upon availability in our warehouse and after submitting of the package to the courier company, you will receive an email when the products/goods will be delivered to you.

Step 4. The contract is considered finalized when the ordered products/goods are dispatched unless your order is not accepted or you decide to cancel it, in which case you must inform us within 24 hours after you have made your order.

An order cancellation from our side may be due to the fact that the product is not available in our warehouse, or we have not received a payment confirmation if it is done in advance, or a mistake in the order process.

IV. Payment and delivery

The delivery price with Speedy is 3.90 BGN, and with Econt Express is 5.90 BGN, for orders above 35.00 BGN the delivery is free of charge. You can pay for your order in one of the following way: Cash on delivery with Postal Money Transfer - For your payment, the courier company will issue a postal money order receipt of the amount of the cash on delivery you owe. This receipt is a document recognized by law which exempts the trader from the obligation to issue a receipt. This is one of the variants according to the Regulation No. H - 18 of 2006, Art. 3 on "Registration and reporting of the made sales", which can be performed by a licensed postal operator, such as Speedy or Econt Express. Please keep in mind that you must save and apply this receipt if you have an invoice issued as it serves as the current receipt.

The delivery is made by Speedy or Econt Express shipping company to your address or your preferred office on the territory of the Republic of Bulgaria. Delivery time (for orders made until 14:00 on a working day) is one to three working days. For settlements without an Speedy or Econt Express office deliveries are made twice or three times a week or once a week, so the delivery time can be extended according to the visit schedule of the courier. When the order is made on Saturday or Sunday, or on a public holiday, it will be processed and shipped on the first working day and received in accordance with the delivery time to the respective settlement.

If it turns out that the product you have ordered is not available, meanwhile you will be notified. The delivery time in this case is different and it is determined by the date of receipt by the manufacturers but we cannot guarantee that they have the respective product in stocks and will deliver it on time. Regarding the prices, the amount that has to be paid is the one that is valid at the time of the order. If we have made a mistake in a product price, we will inform you of the correct value, in which case you can cancel the order and we do not owe you compensation.

Prices of products and services include VAT. 

V. Claims

You have the right to return the products you have ordered within 14 days of receipt of the shipment, in condition that they have not been used and the conditions of Art. 55 (para.1) of the Law on Consumer Protection Act in Bulgaria are respected. The amount for the order will be refunded to you, but the shipping costs are at your expense. In the case of a product delivery with packaging defects that arose during transport, you must contact the courier at the time of receipt to produce a record of damaged shipment.

VI. Others

We reserve the right to modify and supplement these Terms and Conditions as well as the entire content of the website without notice, and if you continue to use it after the changes made, it means that you agree with them.

We do not take any responsibility if the user, in this case you have not read and you have not become familiar with these Terms and subsequent changes thereto.
